Une réplique du Sud à l’extension du droit des brevets : La biodiversité dans le régime international de la propriété intellectuelle

 A Southern Reaction to the Extension of Patent Law : Biodiversity in the International Regime of Intellectual Property(only available in French). International intellectual property law prescribes that patents should apply to genetic material. Several non-governmental organizations and biodiversity rich countries are opposed to this extension of patent law and claim new property rights on genetic resources and traditional knowledge. The draft agreement of the Free Trade Area of the Americas Zone reflects this new polarization and contains provisions on plants’ patentability and others on biological diversity protection. This example shows that the international patent regime has become a place where biotechnology rich countries and biodiversity rich countries are engaged in more balanced negotiations.
